DWI Trial Starts For Man Whose Crash Killed Deputy

A DWI trial is underway this week for a man involved in highway crash that killed a Lubbock County Sheriff’s Deputy two years ago. Justin McKinney was believed to have been drunk when his pickup truck hit a patrol car, killing Corporal D. Robert Harvey. The accident occurred near 88th Street and Martin Luther King Boulevard in April 2009. Police originally charged McKinney with intoxicated manslaughter. But in February 2010 that charge was dismissed after a DPS investigation concluded that other factors besides intoxication could have caused the crash. McKinney is now being tried on a misdemeanor DWI charge. If convicted he could be jailed for up to six months and fined no more than 2,000 dollars.
