Hernandez Had Previous Tax Problems

Lubbock city councilman Victor Hernandez has been in the news this week because of tax problems, but  this is not the first time.

According to an article on lubbockonline.com from 2002, when Hernandez was serving an earlier term on the council, he was also delinquent in paying property taxes, including $190 owed to the city. 

At the time, according to a city hall source, there was uncertainty about whether unpaid taxes were considered to be a debt.   But according to the source, current state law makes clear that an unpaid tax is a debt.

As KFYO has reported earlier this week, tax records indicate that throughout his current term, which began last year, city councilman Victor Hernandez has been indebted to the city for taxes in 2009.  Under the city charter, that would mean that Hernandez was not eligible to serve on the council, and that would raise questions about the validity of every vote he cast as a member of the council.
