Martin: Curfew Is Constitutional, No Outside Lawyers Will Be Needed to Defend It

On Lubbock’s First News on KFYO, Mayor Tom Martin said the city can’t stop someone from filing a lawsuit to nullify the curfew ordinance regarding the Mahon Library and 3 other city buildings, but he believes the ordinance is constitutional, and he said lawyers already working for the city can handle any lawsuits that are filed, instead of outside attorneys.

“You bet.  There’s no reason they can’t,” Martin said.  ” They’re very well versed on it.  They’ve done the research.  The ordinance…is modeled after one from the city of  Dallas.  Almost word for word.  Federal courts in Dallas ruled that it is constitutional.”

Martin said that after the curfew is approved a second time, he expects the ordinance will take effect in the middle of January.
