Key legal issue at stake in legal arguments over Leach vs Tech suit

A key issue is to be argued today in the resumed legal battle between former Texas Tech football coach Mike Leach and the university over his firing. Oral arguments will be made before a three-judge appeals panel on  State District Judge Bill Sowder’s ruling that Leach can sue the university for breach of contract. Tech contends that as a state agency it is immune against being sued. Tech attorney Dicky Grigg said yesterday they  believe that  the Court of Appeals after reading the briefs and hearing the arguments will agree to dismiss the case in its entirety. Leach attorney Ted  Liggett said he expects a quick decision by the appellate panel, possibly by the end of the year. Leach himself was not expected to be at the legal session, which is taking place at Lubbock Christian University.
